Pa. Eatery wants the virus insurance suit suspended for 3rd Circ.

By Joyce Hanson (September 24, 2021, 8:57 p.m. EDT) – A Pittsburgh restaurant has asked a Pennsylvania federal court to stay its lawsuit for insurance coverage for losses from the pandemic, saying the Third Circuit is now considering a group of appeals that could resolve most of the issues in the case.

Umami Pittsburgh LLC asked the court to stay the proceedings in its action against Motorists Commercial Mutual Insurance Co. on Thursday, arguing that 14 appeals currently consolidated in the Third Circuit are based on the same questions of whether the business interruption losses caused by the COVID-19 pandemic and related government shutdown orders should be considered covered by most insurance plans.
